1. Acceptance of Terms & Services
By creating an account, purchasing a package, or using the Assessment as Learning platform, you agree to comply with and be bound by these Terms and Conditions and our Privacy Policy. These terms apply to all students, parents, and visitors who access our service.
2. Account Registration and Lifetime Access
- Single User Only: Your account is personal to you. You may not share your login credentials with other students, tutors, or institutions.
- Academic Lifecycle Decommissioning: Access to purchased subjects remains active strictly until the final day of the external examination for that selected subject in your registered academic finishing year. Accounts and historical dashboard data are automatically decommissioned on January 1st following your graduation year to keep our platform affordable.
3. Fair Use Policy (“Unlimited” Practice)
We provide “Unlimited” AI-powered practice prompts to give students flexible, robust exam preparation. However, to prevent automated scraping, bot activity, account sharing, or unreasonable strain on our state-of-the-art AI infrastructure, the following Fair Use Policy applies:
- Cap Per Subject: “Unlimited” access is defined under this Fair Use Policy as a maximum of 200 AI-generated practice responses or marking attempts per subject, per academic year.
- Threshold Breaches: This volume is mathematically calculated to far exceed a standard student’s healthy writing capacity under examination pressure. If an account exceeds 200 attempts for a single subject, we reserve the right to review account activity, suspend access if account sharing or automated use is suspected, or require a top-up fee for continued access.
4. Intellectual Property and Content Use
- Limited License: Permission is granted to access and use the practice questions, feedback, and dashboard metrics for personal, non-commercial educational study only.
- Restrictions: You must not copy, reverse-engineer, scrape, or use our AI prompt outputs to train competing LLM models or distribution networks. All proprietary pedagogical frameworks and algorithms remain the exclusive property of Assessment as Learning.
5. Disclaimers & Pedagogical Limits
- “As-Is” Feedback: Our platform delivers instant feedback utilising state of the art artificial intelligence aligned with official marking rubrics. However, AI feedback is pedagogical guidance, not a guaranteed grade.
- No Grade Guarantee: Assessment as Learning makes no warranties or guarantees that using this platform will result in a specific ATAR, band level, or school assessment mark. Final examination outcomes depend entirely on individual student performance under official examination conditions.
6. Limitations of Liability
To the maximum extent permitted by Australian Consumer Law, in no event shall Assessment as Learning or its suppliers be liable for any damages (including, without limitation, loss of data, loss of exam marks, or technical downtime) arising out of the use or inability to use the materials or AI tools on this website.
7. Changes to Terms
We reserve the right to revise or update these terms at any time to reflect updates in tech infrastructure, syllabus changes, or legal requirements. Continued use of the platform after updates implies acceptance of the new terms.
